Vacation Rental Agreement
THIS IS A VACATION RENTAL AGREEMENT ("AGREEMENT"). THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY THE TERMS OF THIS AGREEMENT AND BY LAW. YOUR SIGNATURE ON THIS AGREEMENT AND/OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL. THIS AGREEMENT SHALL NOT BE CONSIDERED BINDING UNTIL SIGNED BY ALL PARTICIPATING PARTIES. This Agreement is made and entered into by and between Saad & Vallas Realty Group, L.L.C. ("Agent"), for the owner ("Owner") of the Property and the undersigned "Tenant," whether one or more. In consideration of the mutual covenants and conditions herein, the Agent, acting solely on behalf of the Owner, does hereby lease and rent to the Tenant the Property hereinafter identified upon the following terms and conditions.
TERMS AND POLICIES OF YOUR VACATION RENTAL AGREEMENT
Check-in time after 3 P.M.
Check out time before 11 A.M.
- PAYMENT: A reservation processing fee of $25 and the first night's rent plus applicable tax is due within seven (7) days of making the reservation. The advanced first night's rental payment is applied to the full rental balance upon check-in. Monthly reservations require the first month's rent 30 days before arrival. Checks or money orders drawn on a U.S. bank, Visa, MasterCard, American Express and Discover are accepted. Full payment is due at time of check-in.
- SECURITY DEPOSIT: In the event payment is not by credit card, a credit card number must be given for all reservations to act as a security deposit. This credit card number will be charged to cover extra accommodation costs, loss or damage to the rental property in excess of normal wear and tear during the period of rental. Guests will be notified within 30 days of any charges made to the card. The property should be left clean and undamaged. If the property is not left in a suitable condition, it may be necessary to charge the security deposit for costs to cover extra cleaning.
- CONFIRMATION: Confirmation of your reservation will be emailed upon receipt of the reservation advance payment. Please read the confirmation for accuracy of dates and accommodations.
- FAMILY GROUPS AND SINGLES: Through contract with Owner, Agent is authorized to rent only to family groups and singles 25 years of age or older. Groups renting under false pretenses will be evicted without refund. Occupancy is limited to the stated occupancy on this Agreement. Over-occupancy is considered a VIOLATION of this lease. The hosting of parties on the premises is not permitted at any time. RVs are not permitted on the grounds of any unit at any time. Subletting is not permitted.
- ACCOMMODATIONS AND FURNISHINGS: All rental properties managed by Agent are privately owned and furnished by each Owner according to their taste. Kitchens come stocked with adequate cookware and dinnerware. Beds have mattress pads, bedspreads, blankets and pillows. You will need to bring all paper products, soaps, staples, personal items, and kitchen linens.
- PET POLICY: Pets are not permitted in any rental unit. A pet, or evidence of a pet, will result in forfeiture of rent and eviction. We will be happy to recommend local kennels.
- REPAIRS AND SERVICE CALLS: Please report any malfunctioning equipment or damage as soon as possible. Every effort will be made to correct the situation as soon as possible. Repairmen may enter the premises during business hours for purposes connected with repair, care, or maintenance of the rental property. There will be a $25.00 fee for providing entry to guests that lock themselves out of their vacation home during non-business hours.
- PERSONAL ITEMS: Items left by Tenant upon departure are not the Agent's responsibility. If items are discovered, they will be returned only if Tenant reports missing items to Agent within thirty (30) days of departure. Tenant shall pay all shipping, handling and postage (minimum $25.00) for all returned items prior to shipping.
- POOLS: The Property is equipped with a two large pools and a kiddie pool Tenant hereby accepts and agrees to the following: a. Tenant shall ensure use in a safe manner at all times and that juvenile use is supervised by an adult. b. Unsafe and/or unsupervised use by Tenant or Tenant's guests shall permit Agent to terminate IMMEDIATELY WITHOUT NOTICE Tenant's occupancy of the Property. c. Tenant shall
indemnify and hold Agent (its officers, employees, agents and equity holders) and the Owner of the Property harmless from and against any and all liabilities, claims and expenses for personal injury or property damage resulting from unsafe and/or unsupervised use by Tenant or Tenant's guests. Pool use is "At Your Own Risk". Damage to the pool itself due to Tenant misuse will result in additional charges.
- PARKING: Parking is limited to paying guests only. You are subject to the parking regulations as set by the property owners. If you are bringing a boat, please call in advance to make arrangements.
- DEPARTURE CLEANING AND TAX: A departure cleaning/linen fee is charged once to each reservation. The current condominium housekeeping fees are 2BR-$55 plus tax and 3BR-$65 plus tax. An 11% lodging tax will also be included in your rental bill.
- GRILLING AND FIREWORKS: Fire department regulations prohibit use of a grill on all decks, porches and balconies. Sea Oats has approved grills available for your use at ground level. Fireworks are prohibited from use anywhere on the premises! The use of fireworks on buildings, grounds or the beach is against city ordinances and the fire code.
- INCLEMENT WEATHER: Refunds will not be made due to inclement weather. If evacuation is mandated by civil authorities, you will be given a refund for the unused portion of your rental period.
- CANCELLATIONS: A $25 service fee is assessed for all cancellations. However, if you cancel less than seven (7) days prior to arrival, your advance payment will be forfeited. If you cancel your monthly reservation less than 30 days prior to arrival, your advance payment will be forfeited.
- INDEMNIFICATION AND HOLD HARMLESS; RIGHT OF ENTRY; ASSIGNMENT: Tenant agrees to indemnify and hold harmless Agent and the Owner from and against any liability for personal injury or property damage sustained by any person (including Tenant's guests) as a result of any cause, unless caused by negligent or willful act of Agent or the Owner, or failure of Agent or Owner to comply with local laws. Tenant agrees that Agent, the Owner or their respective representatives may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvement thereto as Agent or Owner may deem appropriate, or to show the Premises to prospective purchasers or tenants. Tenant shall not assign this Agreement or sublet the Premises in whole or part without written permission of Agent.
- ADDITIONAL PROVISIONS/DISCLOSURES: a. Tenant acknowledges that Agent may have an ownership interest in some properties; b. Agent may be paid a commission from other vendors; c. Rearranging of the furniture is not permitted; d. If a telephone is available on the Property, Tenant shall be responsible for all toll calls; e. Tenant acknowledges that construction may be ongoing at adjoining or nearby properties. Neither Agent nor Owner is responsible for any objectionable noise or activity related to same; f. Every effort has been made to assure the information on website, brochure and given by our Agent is correct. Agent cannot be held responsible for changes made by Owners, unintentional misrepresentation or printing errors. Rates and specials are subject to change without notice.
CHECK OUT PROCEDURES:
- Please make sure the kitchen is left clean with all dishes, pots, and pans washed and put back in the appropriate cabinets.
- Please make sure all trash is removed from your property before you check out. Sea Oats has two large dumpsters on site.
- Please set the thermostat temperature at 75°F for summer and 65°F for winter.
- Our housekeepers will strip and remake the beds, replace linens, vacuum, dust, clean the bathrooms, and mop the kitchen floor. If additional cleaning is required, you will be charged.
Keys must be returned to your Unit's lock box. Unreturned or lost keys will result in the lock being changed at a cost to you of not less than $50.00.
